By accessing or using Kilto (the "Service"), you agree to be bound by these Terms of Service. If you use the Service on behalf of an organization, you represent that you have authority to bind it, and "you" refers to that organization. If you do not agree to these Terms, do not use the Service.
Kilto is a customer-relationship and marketing platform that lets businesses manage contacts, content, and connected social-media accounts (including Instagram) from one workspace. We may add, change, or remove features over time to improve the Service.
You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for your account credentials and for all activity that occurs under your account. Keep your password secure and notify us promptly of any unauthorized use.

When you connect an Instagram or other social account, you authorize Kilto to act on your behalf only for the features you enable (publishing, analytics, messaging, comment management). You remain responsible for complying with the terms and policies of those platforms, including the Meta Platform Terms and the Instagram Terms of Use. You are solely responsible for the content you publish through the Service.
You retain ownership of the content you create or upload ("Your Content"). You grant Kilto a limited, worldwide, non-exclusive license to host, process, and transmit Your Content solely to operate and provide the Service (for example, to publish a post to a connected account on your instruction). You represent that you hold the rights necessary to publish the content you submit.
The Service, including its software, design, and trademarks, is owned by Kilto and its licensors and is protected by intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding.
Some features may require a paid subscription. Applicable fees, billing cycles, and refund terms are presented at the point of purchase. Unless stated otherwise or required by law, fees are non-refundable. We may change pricing with reasonable advance notice.
The Service integrates with third-party services such as Meta and Instagram. Your use of those services is subject to their own terms, and we are not responsible for their availability or actions. A third party may change or discontinue its API at any time, which can affect related features of the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that publishing to third-party platforms will always succeed.
To the maximum extent permitted by law, Kilto will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the 12 months before the claim.
You may stop using the Service and delete your workspace at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. On termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will continue to apply.
We may update these Terms from time to time. When we make material changes, we will update the date below and, where appropriate, notify you. Continued use of the Service after an update means you accept the revised Terms.
These Terms are governed by the laws of the jurisdiction in which Kilto is established, without regard to conflict-of-laws rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where applicable law provides otherwise.
